Deaf Father Shot By Racist Neighbor

EXCLUSIVE VIDEO: A Father was called 'deaf and dumb' before being shot by other father in the neighborhood of Florida.

JACKSONVILLE, FL - The victim in a neighborhood shooting, a Deaf man, said the shooter mocked his disability before firing the gun. The victim is recovering after his neighbor shot him Sunday evening, police said.

The man's wife said she was watching from her window when everything unfolded. She said her husband got shot and fell on the ground. Surveillance video recorded screams in the Hunter's Way Apartments Sunday evening.

"I mean, instantly everybody was in panic mode," said Richard Royal. Royal was one of of the neighbors who rushed in to help 50-year old Allen Zogleman after a bullet grazed his head. His cameras captured the moments leading up to the shooting. "I don't think no one expected he was going to pull a gun out," said Royal.

It started with some sort of incident between Zogelman's and the suspect's children arguing. When Zogleman tried to explain he's Deaf, he was shot. Neighbors say the bloody sight unfolded in front of dozens of children. One of those kids was Zogleman's 4-year-old daughter.

Zogleman and his wife are both Deaf.

Action News' Brittany Jones went to talk to them and exchanged notes. His wife said the suspect's son struck her daughter in the head with a pole, and Zogleman yelled to her through their apartment window and went downstairs to talk to the boy's dad. She said that then, the man got into her husband's face, yelling. She said the suspect said her husband was "deaf and dumb," then shot him and left.

The neighbor's surveillance video shows a white car speeding off right after the shooting happened, but no one has seen the suspect since.

Actions News obtained photos of Zogleman's injuries. "Somebody like that shouldn't be loose on the streets. To pull a gun that fast and shoot somebody an unarmed man; an unarmed Deaf man," said Royal... Read more: actionnewsjax.com/news/news/local/family-father-was-called-deaf-and-dumb-being-shot-/nkh8B/

Deaf Football Lawsuit For Discrimination

VIDEO: Family of Deaf child sues football association for discrimination in Minnesota.

MINNEAPOLIS, MN - A Fridley family filed suit this week against the Spring Lake Park Panther Youth Football Association over their Deaf son’s participation in the league. They believe the nonprofit should’ve paid for interpreters and allowed the family to use a special drum to signal the start of play.

Nine-year-old Dov Nathanson says he loves to play football. “I just think it’s cool. I love to tackle people it’s exciting,” he said.

Dov and and his brother Galvin are both Deaf, and they’ve played football with hearing children for years. But last year, the football association said he and his brother Galvin could no longer use a special drum that helps them know when the play is starting.

“Without it, I couldn’t feel it i couldn’t feel the vibration,” Dov said. “I was never ready for the play.”

Parents David and Gloria Nathanson are also upset that the association said they wouldn’t pay for an interpreter for their son’s last year. They say it’s the association’s responsibility.

“We were very frustrated nobody would listen,” David Nathanson said. “It was like we didn’t have a voice.”

Phil Richard, President of the Spring Lake Park Panther Youth Football Association, says the drum made it interfered with the game for other players, and that the family should be responsible for providing their own interpreter.

“It really just comes down to funding. It’s expensive,” Richard said. “We finished out year with $4,000. The cost of an interpreter is double that, and the law, we feel, protects us from that.”

Both Dov and Galvin plan to register for football again this year. The family says they want the policy changed–to allow Deaf players fair play.

“We’re just hoping that in the future that we will feel included,” Gloria Nathanson said.

Also mentioned in the lawsuit is a claim that David Nathanson was denied the opportunity to coach either of his sons teams last year, which he believes is because he’s also Deaf. He had coached three previous years. SOURCE

Deaf Man Jailed With No Access To Interpreter

VIDEO: Deaf immigrant jailed for stealing iPad that wasn't stolen and no access to interpreter service in Virginia.

ARLINGTON, VA - He knew he was in jail, but he didn't know why. Eventually, Abreham Zemedagegehu learned that he'd been accused of stealing an iPad, an iPad whose owner later found it. He spent the next six weeks in jail, unable to communicate with his jailers because he is Deaf. He described a frightening, isolated experience in which medical procedures were performed without his consent and he feared for his safety.

Zemedagegehu sued the Arlington County sheriff last month in federal court, saying his treatment failed to meet the standards of the Americans with Disabilities Act.

"I felt like I was losing my mind," Zemedagegehu said through an interpreter in an interview at his lawyer's office. "I thought Virginia would give me an interpreter and they said no. That's why I felt lost."

Zemedagegehu, who is homeless, is a U.S. citizen who was born in Ethiopia. He grew up using Ethiopian Sign Language. He has learned American Sign Language, but he has never learned more than rudimentary written English.

Maj. Susie Doyel, a spokeswoman for the sheriff's office, which runs the jail, declined to comment on the specific allegations. She generally defended the jail's ability to handle Deaf inmates and others with disabilities, and said several deputies in the jail are proficient in sign language.

But she also acknowledged that communication with a Deaf inmate is more problematic in cases where the inmate can't communicate in written English.

In court papers filed Monday, lawyers for the sheriff ask a judge to dismiss the case, arguing that even if Zemedagegehu's allegations are true, they fail to show intentional discrimination because they attempted various different ways to communicate with him, including handwritten notes.

And even if the discrimination were intentional, the lawyers write that it would not violate federal law because there is a rational basis for the discrimination: "it takes extra resources and creates additional security considerations to bring in an ASL interpreter," they write... Deaf Holocaust Survivors - Remembrance Day

VIDEO [CC] - German Nazi concentration and extermination camp Auschwitz in Oswiecim, Poland. January 27 is International Holocaust Remembrance Day.

Deaf survivors of the Holocaust gathered around the globe on Tuesday on the 70th anniversary of the liberation of Auschwitz-Birkenau to remember the mothers, fathers, siblings and others lost to genocide - the pain of memory of the squalid ghettos, the inhuman Nazi death camps, of starvation and terror.

This documentary covers the treatment of Deaf and Hard of Hearing people in Nazi Germany during World War Two. 17,000 Deaf people were forcibly sterilised by the Nazis to stop them from having children and many others were killed simply because they were Deaf - in a bid to improve the German gene pool.

As part of the season of programmes commemorating the 70th anniversary of the Holocaust and the liberation of Auschwitz, Clive Mason visits the killing centre of Hadamar to investigate the development and impact of the Nazi policy of enforced sterilisation and the murder of Deaf and Disabled people, which took place in Germany between 1933 and 1945. Members of the German Deaf community, who are still living with the legacy of this brutal Nazi policy, tell their moving stories for the first time on television.

Stop Discrimination Deaf People

VIDEO [CC] - Deaf people should be treated as equal and not discrimination.

This video to educate for hearing people which apparently to stop treating Deaf and Hard of Hearing people as second-class citizen. The business corporations or small companies often denied the job applicants which Deaf and HOH feels treated as less important than those of other people in the same society.

We don’t hire Deaf people here.”

“I’m sure you can do lots of things. But this is not the job for you.”

"The next time you come in here, bring an interpreter.”

“I think you people would rather work with people of your own kind.”

Unfortunately, when Deaf and Hard of Hearing people look for work, they may encounter employment discrimination. Prospective employers can discriminate, either openly or subtly. This discrimination happens because of either overt prejudice, or because of ignorance about deafness and hearing loss. For example, an employer may errenously think that a Deaf employee will need an interpreter all of the time.

Deaf People Can Do Anything Except Hear!

The Americans with Disabilities Act (ADA), which was amended by the Americans with Disabilities Act Amendments Act of 2008 ("Amendments Act" or "ADAAA"), is a federal law that prohibits discrimination against qualified individuals with disabilities. Federal Bans Housing For Deaf Seniors

Federal government builds housing for Deaf seniors, bans housing for Deaf seniors.

FrontPage Magazine: The United States government has three important functions. Collecting taxpayer money, building housing for Deaf seniors and making housing for Deaf seniors illegal.

his is a true story of how the government fulfilled two of its main functions at the same time by building and banning housing for Deaf seniors.

Arizona is defying a federal order to eliminate apartments for Deaf seniors at a housing complex built specifically for the Deaf.

A 2005 federal study found that the U.S. had virtually no affordable housing for the Deaf. So the federal government helped build Apache ASL Trails, a 75-unit apartment building in Tempe, Arizona., designed specifically for the Deaf. Ninety-percent of the units are currently occupied by Deaf and Deaf-Blind seniors.

But now, the federal The U.S. Department of Housing and Urban Development says Apache ASL Trails violates civil rights law because it shows a preference for the hearing-impaired.

HUD is threatening to pull all federal housing aid to Arizona unless it limits the number of hearing-impaired residents to 18 people.

However, when HUD approved and helped fund the project in 2008, it did so knowing that the property was specifically “designed for seniors who are Deaf, Hard of Hearing and Deaf-Blind.” ... Deaf Customers Sue Starbucks Over Mocking

Deaf customers sue Starbucks, claim discrimination. Starbucks employees allegedly laughed at speech of hearing impaired customers in New York City.

NEW YORK CITY - Twelve Deaf Starbucks customers in New York City have filed a lawsuit against the Seattle-based coffee company, claiming discrimination. Starbucks employees allegedly mocked the customers multiple times over the course of several years, and once called the police on a monthly meeting of Deaf people.

"Cruel Employees" at two different Manhattan Starbucks mocked Deaf customers and refused to serve them, a stunning new lawsuit says.

"They were ridiculed, laughed at and told they had to leave Starbucks," said lawyer Eric Baum, who's suing on behalf of a dozen Deaf customers.

Jamie Riley, a spokeswoman for the mega-popular coffee chain, said they were aware of the allegations and were investigating them. "Discrimination of any kind is unacceptable at Starbucks," she said.

The suit says one incident took place at a Starbucks at 424 Park Ave. South in August 2012, when customer Alan Roth said a barista laughed when he placed his order, telling him he "sounded funny."

She "asked him to continually repeat himself as she laughed harder each time," and she was soon laughing "hysterically," the suit says.

When Roth demanded to speak to a manager, the employee started screaming obscenities at him and had to be restrained by other Starbucks staff, the suit says. Another employee told Roth to leave and never come back, the suit says.

Roth said he had "never before been so blatantly and maliciously been discriminated against."

The suit says Deaf customers also were forced to leave and had the cops called on them another time at the 13-25 Astor Place location, which had been chosen as the monthly gathering spot for an informal "Deaf Chat Coffee" social group. Deaf Schools 'Home' (VIDEO)

VIDEO: [CC] - American Sign Language storytelling of the Deaf Schools 'Home'

Deaf Institutions, Since 1950, over 67 percent of our homes are disappearing in America. - In this day and age of economic cuts, the closure of educational programs and schools for the deaf has been viewed as a convenient way to reduce budgets. Over the past 63 years, several schools for the deaf have been closed and numerous others have experienced cuts as well as the threat of closure.

Closing such schools actually result in increased long term costs for states rather than serving as a cost-saving measure and, more importantly, result in severe educational deficits for many Deaf and Hard of Hearing children.

TUCSON, AZ. - Two state agencies are investigating the superintendent and board president of the Arizona State Schools for the Deaf and the Blind for potential conflicts of interest and excessive travel expenses.

Superintendent Robert Hill and ASDB Board President Bernhardt Jones also have been the focus of multiple protests at school's two main campuses in Tucson and Phoenix over the last two weeks. Students, parents and former employees have called for the two to resign because of a lack of leadership and poor communication with the staff.

Among the concerns:

• Possible conflicts of interest: Hill and Jones have a private business relationship outside their ASDB positions. Jones is the director of TASK12, which administers the Educational Interpreter Performance Assessment for a $310 testing fee. Deaf Woman Suing Former Employer For No Terps

Deaf woman suing former employer for not providing sign language interpreter. Discrimination suit filed.

ROSEVILLE - A local nonprofit dedicated to helping people with special needs is being sued for allegedly discriminating against a former employee with disabilities.

The lawsuit says Placer ARC violated federal law when it failed to provide reasonable accommodations to a Deaf employee.

Homeyra Kazerounian is Deaf and uses sign language to communicate. And according to a lawsuit, her supervisors failed to provide an interpreter for her during daily staff meetings and forced her to speak only in English.

“Literally she doesn’t speak anything. She uses American Sign Language,” said David Offen-Brown, Kazerounian’s attorney.

Kazarounian started working at Placer ARC’s Auburn office in 2005 was always given an interpreter during mandatory staff meetings, according to the federal lawsuit. But when she transferred to Roseville three years later, her attorneys says that all changed.

“They required her to communicate by writing notes,” said Offen-Brown.

According to a lawsuit filed by an attorney for the Equal Employment Opportunity Commission, Kazerounian’s consistent requests for an interpreter went unfulfilled.

“This didn’t allow her to participate in the meetings, to ask questions, to make statements, to participate in discussions,” said Offen-Brown.

Deaf Prisoner Advocacy: Lobbing The FCC For Change

VIDEO [ASL/CC] - Deaf Prisoner Advocacy Lobbying the FCC for Change: Discrimination Against Deaf, Hard of Hearing & signing users.

HEARD interns Rita Torres & Alexandre Dubsky explain how the Community can support equal communication access for all Deaf, hard of hearing, speech impaired prisoners and their family members.

On December 28, 2012, the Federal Communications Commission (FCC) released a Notice of Proposed Rulemaking (NPRM) to address the long-standing issue of high prison telephone rates. Hearing prisoners' telephone calls can cost their family members as much as $17 for just 15 minutes of time. These excessive rates prevent families from maintaining contact with loved ones.

Deaf, hard of hearing, Deaf-Blind, speech impaired, and hearing prisoners with Deaf family members endure an even greater financial burden with respect to telephone rates due to a number of factors, including (1) telephone rates being applied evenly to TTY and regular voice phone calls, the former of which is much more time-consuming; (2) failure of prisons to install videophones and captioned telephones; (3) security measures that either prevent Deaf prisoners from calling relay operators or cause them to incur additional fees by requiring relay services; and (4) security measures that require Deaf prisoners to only place collect calls.

The FCC has requested public comments on whether prisoner phone rates should be reduced and capped and on Deaf & disabled prisoner telecommunications access. This video explains some of the inequities that persist for Deaf, signing & speech impaired prisoners and their families with regard to rates for and access to telecommunications in prison. Please follow the directions in the document to submit a comment to the FCC. http://www.fcc.gov/

Deaf Community Sues Welfare For Lack Of Interpreters

Deaf Pennsylvanians lawsuit welfare for lack of interpreters: U.S. judge eyeing deal to aid state's Deaf, intellectually disabled human service system clients.

HARRISBURG - A federal judge is being asked to approve a settlement of a class-action lawsuit that would ramp up the state's responsibility to individuals who are Deaf and intellectually disabled.

A key provision of the proposed deal U.S. Middle District Chief Judge Yvette Kane is weighing would require the state Department of Public Welfare to hire sign language interpreters and other specialists to improve communications with Deaf and intellectually disabled clients in the human services system.

About 250 such clients have been identified so far in the state's system of group homes and other service providers, according to filings in the case. Also, DPW would have to pay $450,000 to the Disability Rights Network of Pennsylvania, which filed the lawsuit against DPW in 2010 on behalf of a disabled client identified in court papers only as Harry M.

In seeking approval of the settlement, the rights network stated that DPW officials also have signed off on the proposed deal. The rights network claimed in its lawsuit that the state is not properly helping intellectually disabled Pennsylvanians who are Deaf, because service providers often cannot effectively communicate with them.

Clients who would be affected by the settlement receive services from their home counties through the state-funded Home and Community-Based Waiver, also known as the Consolidated Waiver program. ... Read more: http://www.pennlive.com/midstate/index.ssf/2013/02/us_judge_eyeing_deal_to_aid_st.html

Deaf Gay Man Sues D.C. Jail For Mistreatment

VIDEO: Deaf gay man alleges mistreatment at D.C. jail.

WASHINGTON, DC - A former inmate in the District of Columbia correctional system is suing the city for alleged mistreatment. The D.C. man is Deaf, and the lawsuit claims he was unable to effectively communicate during his period of confinement. It also alleges his treatment got worse when he complained.

44-year-old William Pierce is profoundly Deaf. He wound up with a 60-day sentence in the city's correction system after an altercation with his partner resulted in a conviction for simple assault.

At the order of the judge, Pierce actually wound up in the Correctional Treatment Facility to get help. The CTF adjoins the city jail.

Arthur Spitzer, an attorney for the American Civil Liberties Union of the Nation's Capital, said in an interview: "There was no interpreter there for [Pierce] at intake, or at any of his medical appointments, he had some medical problems or at any of his classes. He was taking an anger management class, and he didn't know what was going on. He didn't know what people were saying. He couldn't participate in the group discussion(s)."

The lawsuit says, under the Americans with Disabilities Act, accommodations for the Deaf must be made so inmates can communicate. Washington Blade - Gay Deaf man sues city for mistreatment.

WASHINGTON, DC - In a lawsuit filed in federal court on Feb. 1, a former D.C. jail inmate who’s Deaf and gay, accuses the city’s Department of Corrections of engaging in disability-related discrimination by refusing to provide him basic services required by the Americans with Disabilities Act.

William Pierce, 44, who was sentenced to two months in a city jail for an assault conviction, charges in the lawsuit that jail officials repeatedly refused to provide a sign language interpreters as required by law and retaliated against him for complaining about his conditions by placing him in solitary confinement.

Pierce, who has HIV, was given only three of the four HIV medications he had been taking at home and was unable to understand why prison doctors changed his medication regimen because of the lack of a sign language interpreter, the lawsuit says.

It says the emotional distress Pierce suffered due to the alleged discriminatory treatment was heightened when jail guards handcuffed him shortly before his mother arrived for a visit, preventing him from communicating with her in sign language.

“The District of Columbia needs to be held accountable for its outright discrimination and reminded that people with disabilities cannot just be locked away and ignored,” said Arthur Spitzer, legal director of the ACLU of the Nation’s Capital, which filed the lawsuit on Pierce’s behalf in U.S. District Court for the District of Columbia.

Spitzer said most of the alleged discriminatory actions against Pierce took place at the D.C. Jail’s Correctional Treatment Facility. The CTF is operated by the Corrections Corporation of America, a private company under contract with the city.

“D.C., in turn, needs to hold the Corrections Corporation of America accountable for its continued disregard for the wellbeing of the individuals the city has placed in its care,” Spitzer said in a statement. ...
